Special Counsel Releases Trump's Damning Report

Special Counsel Jack Smith claimed in a damning report released Tuesday that US President-elect Donald Trump would have been prosecuted for his alleged attempt to influence the 2020 election result if he hadn’t been re-elected four years later. The findings infuriated the incoming White House president.

“Had it not been for Mr. Trump’s election and imminent return to the presidency, the (special counsel’s) office believed that the evidence was sufficient to obtain and sustain a conviction at trial,” the report, which was released by US media on Tuesday, stated.

The paper points out that “the Constitution prohibits the indictment and prosecution of a president,” and this concept “does not depend on the seriousness of the crimes charged, the strength of the government’s evidence, or the merits of the prosecution.”

The inquiry into the January 6, 2021, storming of the Capitol by Donald Trump’s followers in Washington to challenge Joe Biden’s election as president has followed Trump, who will return to the White House on January 20.

After the future president won the November 2024 presidential election, Jack Smith, the special prosecutor assigned to oversee the inquiry, dismissed the federal criminal case against him.

“Disturbed”

Donald Trump replied to the report’s release overnight Monday by labelling Mr. Smith “deranged” in a harsh statement posted on his Truth Social platform.

“Deranged Jack Smith failed to bring his “boss,” corrupt Joe Biden’s political rival, to justice.” According to the message, he ultimately wrote another “report” based on evidence that was unlawfully destroyed and erased by a gang of “corrupt politicians and thugs, because it showed how completely innocent I was.”

In another post, the president-elect said, “Deranged Jack Smith published his false conclusions at 1:00 AM to show you how desperate he is.”

According to Mr. Smith’s assessment, Mr. Trump allegedly tried to influence state-level Republican leaders and elected officials to “change the results” of the 2020 election.

The report, which was published online by The New York Times and The Washington Post, asserts that “Mr. Trump contacted elected officials and state officials, pressured them with false claims of voter fraud in their states, and urged them to take steps to ignore vote counts and change the results.”

“It is important to note” that he made speeches “only to elected officials and state officials who shared his political affiliation and were his supporters, and only in states he had lost,” said the study.

Additionally, according to the text, Trump and his associates intended to provide “fraudulent certificates” of electors in seven states—Arizona, Georgia, Michigan, Nevada, New Mexico, Pennsylvania, and Wisconsin—where he had lost.

According to the office of the special counsel, “Trump’s conduct violated multiple federal criminal laws.”

Although charges against two of his former co-defendants are still pending, a separate case against Mr. Trump for his handling of top-secret data after leaving the White House was dismissed last year by federal judge Aileen Cannon, who was selected by Mr. Trump.

A few days after turning in his final report, Special Counsel Smith departed the Justice Department last week.

In a different case, on January 10, a judge declared Donald Trump immune from penalty in connection with his covert payments to a porn star. This was a symbolic but historic punishment because it made him the first American president-elect to be found guilty of a crime.
